On December 6, 2004, eight U.S. soldiers – five stationed in Iraq, two in Kuwait on their way to Iraq, and one home on leave from Iraq about to be shipped back – filed a federal lawsuit challenging the Armed Services’ so-called “stop loss” policy which would require them to serve beyond their enlistment contracts. CCR Vice President Jules Lobel and cooperating attorney Staughton Lynd are representing Specialist E-4 David W. Qualls and seven anonymous (“John Doe”) plaintiffs who are seeking a court order requiring their immediate release from military service. The suit was brought against Secretary of Defense Donald Rumsfeld, Acting Secretary of the Army Les Brownlee, and Secretary of the Army for Manpower and Reserve Affairs, Reginald Brown.

On July 7, 2003, Specialist Qualls, whose military training is in communications, enlisted in the “Try One” program in hopes of becoming a commissioned officer. According to his contract, his term of service should have ended one year later, and he signed it with that expectation. Indeed, the staff sergeant who recruited him stated that Specialist Qualls would serve for 12 months; nothing was mentioned about “stop loss” or about a possible rotation in Iraq.
Thats why you READ the Contract ass ... and since you are a fucking 35 year old man, you should have known better.
My best guess about this situation is that you have a guy here, he wanted to be an army officer (why the fuck for we don't know) but he is 35 ... that means he can't apply to OCS (officer candidate school) as a civilian, but ... on active duty he can apply for a age waiver which would get him into OCS. He joins up thinking his enlisted time will be a short walk through until his paper work goes through. Obviously, his unit got called up, he found out that you can not apply to OCS if you have deployment orders (clearly stated in the regs) and now he is stuck in Iraq as a E-4.
I really feel bad for this guy and his family, but he should of fucking known better, and he has no one to blame but himself for not reading his enlistment contract. On a personal note ... I just want say fuck press for including a pity side note about how much "trama" his family has had to endure. There are over 138,000 soldiers in Iraq, and we all have family.

Qualls’s family has suffered greatly from his absence. Since his deployment to Iraq, his take home pay has been reduced by approximately 80 percent. His wife cannot make payments on their home or family vehicles. Both his wife and daughter have experienced stress since his extended service in Iraq and are taking medication as a result. Mrs. Qualls unsuccessfully applied for a hardship discharge for her husband.
On to my next question, it says here that his take home pay was reduced appox. 80% ... alright ... a E-4 deployed in iraq, with combat pay, family sep, base pay and BAH clears $35,000 easy which is TAX Free. According to this, that is roughly 20% of what he was making, making his civillian salary around $150,000-$160,000 ... why the fuck did he join the national guard?

Let this be a lesson to you kids, if you join the military don't believe the spoken word. Read the contract you sign.

35,000 a year is bullshit...but cant the national guard live on the Post?

holy shit...the PX....like a broke ass walmart...Anyone else remember the Shopette (sp?)? Like a gas station that rents movies....good ole military multi-tasking.

edit- I just remebered....wasnt the liquor store the "Class 6" or something like that.
